How The Process Works

​STEP 1.  Call my office or schedule a free consultation online.  I will explain your options for eliminating debt and keeping your property.
STEP 2.  Whether you want to file a bankruptcy case or settle debt your initial consultation is free and handled right over the phone.
STEP 3.  For bankruptcy cases, you are required to go through a credit counselling course prior to filing.  This can easily be done online.  
STEP 4.  After you have completed a questionnaire, I will use the information you have provided, along with a copy of your credit bureau report, pay stubs and other financial information to complete all the necessary court documents for filing.
STEP 5.  When your case is ready to be filed, I will review it with you, explaining it in detail.  Then once we are both satisfied that it is complete and accurate, you will sign your documents and I will file them electronically with the bankruptcy court.
STEP 6.  In both Chapter 7 and 13 cases you will attend a hearing called the Meeting of Creditors.  You will receive a notice in the mail from the bankruptcy court informing you when to attend your hearing.  I will represent you at this hearing.  In Chapter 13 cases you may have to attend an additional hearing called the Confirmation hearing.  I will represent you at this hearing as well.
STEP 7.  For Chapter 7 cases, after your hearing there is approximately a 60 day wait for your discharge and close of your case.  During this time you should have completed the second part of your credit counselling course.  I will file your second certificate allowing you to get you discharge and you are done.  For Chapter 13 cases, once your case has been confirmed by the bankruptcy court, your main responsibility will be maintaining monthly Chapter 13 Plan payments.  These are the payments setup through your Chapter 13 case to pay back what your plan is set up to pay back, i.e., missed mortgage payments, auto loan payments, back taxes, etc.  You and I will work together to develop a Chapter 13 Plan that gives you the best chance for success.  Once your Chapter 13 Plan is paid you will be entitled to a discharge.  This will be the end of your case.
